Fines from the TCС - under what conditions they can be appealed in court.


If a conscript is not found by the summons, they may be declared wanted and obligated to pay a fine. However, if there were violations during the issuance of the decision, the fine can be appealed.
This was stated by lawyer Maria Hanina in a comment to RBC-Ukraine.
When a fine can be appealed
According to Hanina, one of the reasons for appealing in court is procedural violations: if the summons arrived at the post office after the date of appearance stated in it, or other procedural moments were violated.
Another reason may be the lack of proper notification: if the person was not summoned to the hearing regarding the fine decision or was not properly informed about the case review.
How to appeal a fine from the TCС
The lawyer notes that you can file a lawsuit in court within 10 days from the moment of receiving the decision. You can also contact the TCС that is at a higher level than the one where the person is registered (for example, the Kyiv city TCС for those who are registered at the district TCС of Kyiv).
The lawyer advises to file a lawsuit in court, as the deadlines for appeals to the higher authority are unknown and can be significantly longer. Court appeals can last 4-6 months.
How to delay the payment of a fine
Together with the lawsuit for canceling the fine, you can submit a request to the court to stop the collection of funds from the person's accounts until the case is resolved.
The lawyer emphasizes that conscripts with deferral or postponement usually do not receive summonses. However, sometimes such summonses may arrive if, for example, a person has submitted a request for deferral, but it has not yet been considered.
